Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://kickpilot.me website (the "Service") operated by KickPilot ("us", "we", or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
By creating an Account on our service, you agree to receive essential, service-related transactional emails (such as billing notices, security alerts, and account recovery).
Marketing Communications: You may separately opt-in to receive newsletters, marketing, or promotional materials from us. You are never required to consent to marketing to use our Service, and you may withdraw your consent at any time by following the unsubscribe link or instructions provided in any promotional email we send.
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or KickPilot cancels it. You may cancel your Subscription renewal via your account dashboard or by contacting support.
A valid payment method is required. By submitting payment information, you authorize KickPilot to charge all Subscription fees incurred through your account. Should automatic billing fail, KickPilot will issue an electronic invoice requiring manual payment within a specified deadline.
KickPilot may offer a Subscription with a free trial for a limited period ("Free Trial"). If you enter billing information during signup, you will not be charged until the Free Trial expires. On the last day of the Free Trial, unless canceled, you will be automatically charged the applicable Subscription fees. KickPilot reserves the right to modify or cancel the Free Trial offer at any time without notice.
KickPilot may modify Subscription fees at its sole discretion. Any change will become effective at the end of the then-current Billing Cycle. We will provide reasonable prior notice of fee changes, allowing you to terminate your Subscription before the change takes effect. Continued use of the Service constitutes agreement to the modified fees.
Refund requests for Subscriptions may be considered by KickPilot on a case-by-case basis and granted at our sole discretion.
Our Service allows you to post, link, store, share, and otherwise make available certain information or material ("Content"). You are responsible for the legality, reliability, and appropriateness of your Content. By posting, you warrant that you own the Content or have the right to use it, and that it does not violate any third-party rights.
You retain all rights to your Content. By posting, you grant KickPilot the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. KickPilot has the right but not the obligation to monitor and edit all Content.
Content belonging to KickPilot may not be distributed, modified, or reused for commercial or personal gain without express written permission.
When you create an account, you guarantee that you are above the age of 18, and that the information you provide is accurate, complete, and current. Inaccurate information may result in immediate account termination.
You are responsible for maintaining the confidentiality of your account and password and accept responsibility for all activities that occur under your account. You must notify us immediately of any security breaches. You may not use offensive, vulgar, or unauthorized names as usernames. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
The Service and its original content (excluding User Content), features, and functionality are the exclusive property of KickPilot and its licensors, protected by copyright, trademark, and other laws. Our trademarks may not be used without prior written consent.
Our Service may contain links to third-party websites not owned or controlled by KickPilot. We assume no responsibility for the content, privacy policies, or practices of third-party sites. You acknowledge that KickPilot is not liable for any damages caused by reliance on such third-party content or services.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including a breach of these Terms. If you wish to terminate your account, you may simply discontinue using the Service. Surviving provisions include ownership, warranty disclaimers, indemnity, and limitations of liability.
In no event shall KickPilot, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from (i) your use or inability to use the Service; (ii) third-party conduct on the Service; (iii) content obtained from the Service; or (iv) unauthorized access or alteration of your transmissions or content.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. KickPilot does not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to use our Service after revisions become effective, you agree to be bound by the revised terms.
